1. Acceptance of Terms

By visiting our website (www.mssquaree.com), requesting proposals, entering into Annual Maintenance Contracts (AMC), or utilizing our portal, you agree to be bound by these Terms & Conditions in accordance with the Indian Contract Act, 1872 and Information Technology Act, 2000.

2. Services Offered

MSSQUAREE specializes in turnkey operational management across Mumbai, Navi Mumbai, Thane, and Pune, including:

• CHS Facility Management: End-to-end management of residential society operations, committee reporting, and vendor supervision.
• Society Gym AMC & Setup: Fitness equipment layout, procurement assistance, scheduled monthly AMC visits, and trained fitness attendants.
• Clubhouse Operations: Managing swimming pools, steam/sauna, party halls, indoor courts, and community recreational events.
• Personal Training & Wellness: Certified fitness instructors, diet planning, and group exercise sessions (Zumba, Yoga).

3. Society Committee & Client Responsibilities

• Providing safe, unhindered access to society gymnasiums, machine rooms, and clubhouse facilities during scheduled service hours.
• Ensuring basic utilities (power supply, adequate water pressure, and ventilation) are functional for safe gym operations.
• Prompt notification to MSSQUAREE in case of structural damage or hazards noticed on the society premises.

4. AMC Billing, Invoicing & Taxes

• Monthly or quarterly AMC fees are invoiced in advance or as stipulated in the executed Service Level Agreement (SLA).
• All pricing is subject to Goods and Services Tax (GST) at prevailing rates in India. Valid GST invoices will be provided.
• Replacement spare parts, beyond regular lubrication and standard preventive maintenance, are billed subject to prior committee approval.

5. Limitation of Liability

While MSSQUAREE deploys verified staff and observes industry-leading preventive safety standards, users and residents exercise at their own risk. MSSQUAREE shall not be liable for indirect or consequential damages, individual resident physical overexertion contrary to medical guidance, or damages arising from preexisting structural society defects.

6. Term & Termination

Contracts are typically executed for a period of 12 or 24 months. Either party may terminate the agreement by providing 30 to 60 days written notice as specified in the signed contract, subject to settlement of all outstanding invoices.

7. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of them shall be governed by and construed in accordance with the laws of India. Courts in Thane / Mumbai, Maharashtra shall have exclusive jurisdiction.
